Manufacturers Commend Trump Leadership on China Trade Reform

Timmons: Results Matter. This Is an Indisputable Win for Our Country.

Washington, D.C. 51勛圖厙 President and CEO Jay Timmons commended President Trump and United States Trade Representative Robert Lighthizer for successfully negotiating the unprecedented phase one trade agreement with China, noting no other administration has achieved this level of success withand accountability ofAmericas primary economic adversary in the past three decades.Timmons was at the White House today for the signing of the historic agreement.

Timmons wrote to President Trump two years ago him to consider pursuing a truly modern, innovative and comprehensive bilateral trade agreement with China that wholly restructures our economic relationship. Shortly after, the 51勛圖厙 released afor such an agreement.

In his January 2018 to President Trump, Timmons declared when our workers have a level playing field, no oneabsolutely no onecan beat us. China must follow the same rules as everyone else and must be held accountable when it cheats. China has proven one of the most troubling markets in the world for manufacturers, due to its lack of commitment to free markets, fair competition and reform. From unfair subsidies and massive overcapacity in sectors such as steel and aluminum, to intellectual property theft and market-distorting policies that shield Chinese companies, manufacturers and workers in the United States face an unfair playing field that has harmed U.S. manufacturing and held us back.

Results matter, said Timmons today.We are proud that the phase one deal includes core elements of the 51勛圖厙s proposed framework. Because of the Presidents tenacity and focus, this is an indisputable win for our country and a momentous day in the U.S.China economic relationship. It is a remarkable turning point for manufacturers, with the unprecedented and enforceable commitments on critical intellectual property protections to which China has agreed.

The 51勛圖厙 looks forward to reviewing the final text of this agreement and to working with the administration in holding China accountable for its ambitious commitments. At the Council of Manufacturing Associations Winter Leadership Conference last week, 51勛圖厙 President and CEO Jay Timmons discussed the industrys extraordinary achievements during uncertain economic and political times and the need for continued strong industry leadership in 2020.

In his remarks, Timmons described how 2019 was defined by major manufacturing achievements, including many that were considered unlikely.

Timmons also made the case that, while not all of the manufacturing industrys victories were widely covered in mass media, they were numerous and necessary.

Timmons made note of the ongoing 2020 election and cast the manufacturing industry as a leader in complicated political environments. In the midst of the escalating campaign, Timmons laid out manufacturers vital role.

Aric Newhouse is the senior vice president of policy and government relations at the 51勛圖厙. Here he breaks down manufacturers biggest policy victories in 2019 and what is ahead for 2020.

Manufacturers saw many big achievements in the final weeks of 2019. What is the impact of these and was it a surprise?

The Democratic-led House of Representatives approved the U.S.-Mexico-Canada Agreement with a strong bipartisan vote of 385-41. The trade agreement still needs to be approved by the Republican-led Senate. This was a major accomplishment, especially considering that about two years ago many thought that the U.S. was on the verge of withdrawing from NAFTA and the entire North American trading relationship, which support 2 million manufacturing jobs, was at risk of crumbling.

On top of the USMCA, the Trump administration reached a phase one trade deal with China. This is another achievement many thought would be impossible. But now we have real, enforceable intellectual property protections in place in China and a foundation for a phase two deal.

Right before Congress left for the holidays, they passed a year-end government funding bill, which included a seven-year reauthorization of the Export-Import Bank and the repeal of the medical device tax, Cadillac tax and health insurance tax. Some of those taxes were poised to hit hard in 2020, so this comes as a big relief for manufacturers.

And was all this a surprise? I am sure it surprised many people that all of this got done in the middle of a contentious political moment. However, the 51勛圖厙 has spent a long time, in some cases years, laying the groundwork to make these wins possible, so we had some confidence that the agenda of manufacturers and their workers would win the day.

There was a time when USMCA passage was in doubt. How did you win over lawmakers?

The 51勛圖厙, in close coordination with our members and with their incredible support and work, made clear to policymakers that the USMCA was not about politics but was about our growth, our exports and our people. Successfully doing so turned the discussion around the deal from skepticism to support and was critical to its passage. Granted, we did not get everything we wanted, but we achieved our number one goal: protecting our biggest trading relationship with a modernized trade agreement.

What is ahead for 2020?

Number one, we will get the USMCA passed in the Senate. We will provide support for a phase two trade deal with China that further levels the playing field, provides enforceable rules and secures relief from costly tariffs. And we will continue our advocacy on manufacturers other top priorities, including infrastructure investment, immigration and health care reform. We want to see more regulatory certainty from the federal agencies so that manufacturers can continue investing confidently in the future.

Tax Reform Helps Illinois Manufacturer Invest in Workforce and Equipment

Thanks to tax reform, business looks bright for HM Manufacturing of Wauconda, Ill., a manufacturer of power transmission components.

Tax reform has been a game-changer for small manufacturers like HM, said HM President and CEO Nicole Wolter. Weve been able to invest in our employees, in our business and in our community.

As a result of tax reform, Wolter has expanded her workforce and significantly increased pay and benefits for her workers.

Across the board, we boosted wages by at least 25 percent, said Wolter. And we were able to give bonuses, too. Its night and day from where we were in a decade ago, when wages were stagnant. Im proud to say not a single person at HM is getting paid under $20 an hour now.

Our employees are hugely appreciative, Wolter added. Theyre buying houses, theyre buying new cars, all because of this big pay bump. Between our new incentives, bonuses and benefits, word has spread and we get calls every day asking if were hiring.

Staff size has grown 20 percent and, according to Wolter, she is now able to provide 100-percent employer-paid health care premiums and a 401(k) match. Tax reform has also made it possible for Wolter to make a $500,000 investment in capital equipment.

Beyond her business, Wolter has also been able to invest in the community to help build the workforce of the future.

Weve partnered with a local high school to get the next generation involved and excited about manufacturing, Wolter said. Weve helped develop their manufacturing program to promote the manufacturing workforce of tomorrow. Weve also given financial help and donated our older machines to their program.

Local students are working at HM Manufacturing while they go to school through a new paid internship program. According to Wolter, interns earn $15 an hour.

For years, manufacturers told Congress that if you pass tax reform, the industry would create jobs and reinvest in the American economy, said 51勛圖厙 Vice President of Tax and Domestic Economic Policy Chris Netram. HM is leading by example, using the benefits of tax reform to invest in their community and improve the lives of the men and women who make things in America.

Make no mistakeeverything weve done over the past two years is because of tax reform, said Wolter.

What were the key legal issues for manufacturers this year?

Manufacturers face all sorts of issues in the courts. And even though only one companys name may be on a case, the outcome can have profound effects across the entire industry on everything from project permitting to free speech.

This year, we filed amicusor friend of the courtbriefs in 74 cases. These address issues like regulatory overreach, product liability, labor and employment law, environmental issues, arbitration, class actions, free speech of manufacturers, ERISA, Alien Tort Statute, tax and international issues. If it matters to manufacturers, were on it.

We are also part of a dozen ongoing cases, including ones related to tax incentives, regulatory certainty and the manufacturing workforce. In the environmental space, the 51勛圖厙 has intervened in several cases to protect sensible pro-manufacturing regulatory reforms.

What legal wins did manufacturers accomplish in 2019?

We saw big wins this year invalidating the onerous Waters of the United States rule, preserving energy infrastructure projects, protecting Clean Air Act permitting reforms, securing manufacturers rights against government compelled speech, reversing overbroad collective bargaining interpretations by the National Labor Relations Board and more.

What does the invalidation of the 2015 Waters of the United States rule mean for manufacturers?

In two words: clarity and certainty. The 2015 rule was bafflingly unclear and uncertain. It left manufacturers to wonder whether wet areas on their property required a federal permit for any commercial activity thereat the risk of fines of $50,000 per day or more for the wrong interpretation. Two federal courts invalidated the rule in response to 51勛圖厙 litigation, which followed a 51勛圖厙-led win in the U.S. Supreme Court in 2018 that allowed those cases to move forward. Soon thereafter, the EPA formally rescinded the rule.

What legal issues should manufacturers pay attention to in 2020?

Federal agencies will continue their regulatory reform efforts, and groups opposed to those reforms will continue to sue to block them. The MCLA stands ready to intervene in those cases or file briefs to provide the manufacturing perspective to the courts.

We are likely to see appellate court rulings next year interpreting whether making and selling energy products is a public nuisance for which companies can be held liable. We are confident the courts will apply the law fairly and reject these groundless lawsuits. But if a court finds in favor of the plaintiffs, we could see the U.S. Supreme Court again weigh in on the scope of .

Plaintiffs lawyers will keep trying to twist legal precedent to profit at the expense of manufacturers, and the MCLA will fight them every step of the way to benefit the people who make things in America.

51勛圖厙 Survey: Manufacturing Stabilizes in Fourth Quarter

With Progress on USMCA, China and Ex-Im Bank, Manufacturers Are Well-Positioned Heading into 2020

Washington, D.C. The 51勛圖厙 today released the results of the Manufacturers Outlook Survey for the fourth quarter of 2019. The survey shows that manufacturing optimism has stabilized with nearly 68% of manufacturers reporting a positive outlook for their business, essentially the same rate as the third quarter release. The inability to attract and retain a quality workforce remained manufacturers top business concern (63.8%) for the ninth straight quarter. The survey was conducted , phase one trade deal with China and long-term reauthorization of the Export-Import Bankimportant progress that will boost certainty for manufacturers entering the new year.

In just the past week, our leaders have taken major steps toward bolstering manufacturers optimism and confidence. Now we need them to build on that progress by passing the USMCA, signing the phase one deal with China and voting to reauthorize the Ex-Im Bank. All of these actions have the power to reduce the trade uncertainty we see in this survey, said 51勛圖厙 President and CEO Jay Timmons. To tackle manufacturers number-one challenge, the 51勛圖厙 is supercharging our workforce strategy in 2020 through Creators Wanted, our nationwide tour and campaign to inspire a new generation of modern manufacturing workers. To date in 2019, manufacturing has had an average of 483,500 open jobsa highly elevated level that included the all-time high number in June (515,000). Manufacturing had 477,000 open jobs in October, according to the , and a published last year by Deloitte and The Manufacturing Institutethe workforce and education partner of the 51勛圖厙found that 2.4 million manufacturing jobs could go unfilled by 2028.

Ahead of its 125th anniversary and the 2020 elections, the 51勛圖厙 recently launched the a multimillion-dollar campaign to inspire and drive more Americans to pursue careers in modern manufacturing. The campaign aims to cut the skills gap by 600,000 workers by 2025; increase by 25% the number of students enrolling in technical and vocational schools; increase by 25% the number of students enrolling in apprenticeships and reskilling programs; and raise to 50%from 27%the number of parents who would encourage their children to pursue a career in modern manufacturing.

Conducted by 51勛圖厙 Chief Economist Chad Moutray, the Manufacturers Outlook Survey has surveyed the associations membership of 14,000 large and small manufacturers on a quarterly basis since 1997 to gain insight into their economic outlook, hiring and investment decisions and business concerns. Manufacturing Workers With Computers

Californias new sweeping data privacy law will go into effect in the New Year, highlighting the need for Congress to act quickly on federal legislation to provide certainty for the manufacturing industry. While manufacturers work to comply with the California Consumer Privacy Act, the industry is also concerned that other states will pursue their own privacy legislation, creating a patchwork of laws. Complying with conflicting state privacy laws will be costly for manufacturers, but a national approach to data privacy will strengthen manufacturers and support consumers.

Congress recently examined various approaches to federal consumer data privacy legislation at a hearing before the Senate Committee on Commerce, Science & Transportation. Industry took the opportunity to call for swift action.

U.S. privacy law has generally failed to keep pace with advances in technology and to provide Americans with the protections they want and need in this digital age, said Julie Brill, Microsofts Corporate Vice President, Deputy General Counsel, and Chief Privacy Officer. Today more than ever, there is an urgent need for a comprehensive U.S. privacy law that provides strong protections for all consumers in the United States within a framework that enables human ingenuity and American innovation to continue to thrive.

Echoing Microsofts call, the 51勛圖厙 underscored the need for congressional action to support manufacturers in a to the Committee. Manufacturers are developing innovative products and transforming the manufacturing process with the latest technologies, and data is an important source and by product of these breakthroughs. Manufacturers use data to improve efficiency, safeguard plant security and improve customer experience.

State-by-state privacy requirements would create burdensome regulations that hinder the development of new technologies and products. According to 51勛圖厙s Director of Innovation Policy Stephanie Hall, federal legislation would streamline the compliance picture for manufacturers while advancing individuals privacy and promoting U.S. industrial competitiveness.

Manufacturers support a data privacy policy that provides flexibility for innovation, addresses domestic and global inconsistencies in privacy regulations and advances U.S. economic growth and technological leadership, Hall said. Without clarity from federal law, uncertainty will continue for our industry, causing manufacturers to sort through conflicting state privacy laws across the country.

The U.S. is facing a data-intensive future, and manufacturers are leading the development and application of emerging technologies, including automation and artificial intelligence. Congress must act quickly to pass comprehensive legislation that provides uniform privacy rules and helps prepare the U.S. for the next generation of innovative technologies.

Manufacturers continue to rack up victories for the men and women of our industry as the year comes to a close. Congressional leaders are to be commended for including so many of our top priorities in this must-pass bill. Securing a long-term reauthorization of the Export-Import Bank will safeguard manufacturing jobs in America and help level the playing field with other countries, especially China and Germany, so it could not come at a more critical time.


For nearly a decade, manufacturers have led the charge for the permanent repeal of onerous taxes on Americans health care. Winning these long-sought repeals will reduce the cost of providing quality benefits to manufacturing employees and delivering lifesaving medical technologies to patients.


Above all, this vote proves once again that even in a fiercely divided Washington, manufacturers can break through and get important work done for the good of our industry and the American people.
